Q: Can a person be dismissed if one is found to be deceptive during a polygraph examination?   

A: Polygraph test results, on their own, are not a basis for a finding of guilt. It can be used only in support of other evidence.  


Q What is the status of a polygraph examination test at the CCMA?

A: Suitably Qualified Polygraph Examiner has been accepted as expert witness whose evidence needs to be tested for reliability.   The duty of the Commissioner is to determine the admissibility and reliability of the evidence.  The Polygraph test may not be interpreted as implying guilt but may be regarded as an aggregated factor especially where there is other evidence of misconduct.


The following guidelines of examinee’s rights:

The examinations are voluntary and cannot be forces onto an examinee

He or she has the right to an interpreter

No abuse whatsoever will be allowed

No discrimination will be allowed

No threats will be allowed

Only questions that were discussed prior to the examination will be asked during the test.
